Tooro Succession Row: Attorney General’s Position Could Shift The Battle To Court

The unfolding succession dispute in the Tooro Kingdom could be heading for another dramatic turn, following arguments attributed to the Attorney General on the legal weight of the late King Oyo Nyimba Kabamba Iguru Rukidi IV’s will.

The position being advanced is that the King’s will cannot simply be disregarded. If questions arise over its authenticity or validity, the appropriate avenue for resolving such a dispute would be through the courts.

That argument could significantly complicate efforts to settle the succession question outside the courtroom.

THE WILL QUESTION

At the heart of the latest debate is the status of the late King’s will and what legal effect it should have in determining matters arising after his death.

Those backing the legal argument maintain that a will remains a legally significant document and cannot simply be wished away because some parties disagree with its contents.

However, where its authenticity or validity is challenged, the courts would ultimately be expected to determine the matter based on the evidence and applicable law.

That prospect raises the possibility of a prolonged legal battle at a time when the kingdom is already navigating heightened emotions and competing positions within the royal family.

WHAT ABOUT THE TOORO CONSTITUTION?

Another contentious issue concerns the status of the Tooro Kingdom Constitution.

The argument presented is that the constitution was suspended and remains suspended, creating an unusual legal and institutional environment in which questions surrounding succession may not have a straightforward constitutional pathway.

Whether that interpretation is legally correct, and what consequences it carries for the current succession process, could itself become a matter for judicial determination.

A POLITICAL DEADLOCK?

The debate has also produced a provocative political comparison involving Zambia.

Some commentary has jokingly invoked President Hakainde Hichilema’s past political battles as an example of how political actors sometimes attempt to prevent legal challenges from immediately disrupting a political process.

The suggestion that the Babiito could somehow “lock the courts” for nine days is, however, best understood as political satire rather than a serious or established legal proposal. Courts operate under constitutional and statutory protections, and any attempt to obstruct judicial proceedings would raise serious legal questions.

For now, the more realistic question is whether one or more interested parties will seek judicial intervention to challenge the succession process.

THE COURTS MAY HAVE THE FINAL WORD

If a formal petition is filed, the dispute could move from palace discussions and public statements into a very different arena—one governed by evidence, legal arguments and judicial procedure.

That would potentially give the courts an opportunity to address several unresolved questions, including the status of the will, the applicability of the Tooro constitutional framework and the legality of any proposed succession arrangements.

For ordinary Ugandans watching the developments, the unfolding drama has already become one of the most closely followed royal succession disputes in recent memory.

And, as the saying goes, those watching from the sidelines may need plenty of popcorn.

KEY TAKEAWAYS

The will: Its contents and legal validity could become central to the succession dispute.

The constitution: The reported continued suspension raises questions about what legal framework currently governs succession.

The courts: If a formal challenge is filed, judges—not public opinion—would ultimately determine the legal questions brought before them.

The politics: The succession dispute is no longer merely a royal family matter; it is increasingly attracting wider political, legal and public attention.

The next move: Whether the parties choose negotiation, a royal process or litigation could determine how the dispute unfolds in the days ahead.
